**** RAVI SHANKER JHA, CHIEF JUSTICE ( Oral ) The petitioner has approached this Court against the order dated 03.02.2021 (Annexure P-5) passed by the respondent authorities rejecting his bid, submitted pursuant to the Request for Proposal (RFP) for door to door collection, segregation, transportation as well as processing of waste for Ward No.1-11 issued by the Commissioner, Municipal Corporation, Yamunanagar - Jagadhri.

The petitioner contends that he fulfills the necessary qualification regarding experience and has also filed a certificate in support thereof, but the authorities have failed to take into consideration or to consider it in the proper prospective. It is submitted that the petitioner had filed representations before the respondent authorities, which were not considered. CWP-3505-2021 representation, the authorities shall consider and take a decision thereon expeditiously, as far as possible within a period of one week of its receipt, and communicate the same to the petitioner.

In view of the above, petition is disposed of with liberty to the petitioner to submit a fresh representation to the respondent authorities raising his grievance. In case, the petitioner does so, the respondent authorities shall consider the same and take a decision thereon within a period of one week of its receipt, as undertaken by learned Additional Advocate General, Haryana. It is made clear that this Court has not expressed any opinion on the merits of the case and, therefore, the respondent authorities would be at liberty to examine the representation keeping all facts and facets into consideration and thereafter accept or reject the same in accordance with law. The decision taken on such representation shall be communicated by the respondent authorities to the petitioner.
