HARSH BUNGER, J. (ORAL) Prayer in the present petition, filed under Section 482 of the Code of Criminal Procedure is for issuance of direction to respondent No.2 to direct respondents No.3 and 4 and his officers not to harass the petitioner and his family members.

Learned State counsel has filed a short reply by way of an affidavit of Sh. Daljit Singh, PPS, Deputy Superintendent of Police, SubDivision Garhshankar, District Hoshiarpur, on behalf of respondents No.1 to 4 in the Court today, which is taken on record, subject to all just exceptions. A copy, thereof, has been supplied to learned counsel for the petitioner. In the said reply dated 27.02.2023, the statement of petitionerTirath Ram, has been annexed as `Annexure R-1/T'. The same reads thus :- " Stated that he is resident of above said address and he is doing labour work. He submitted an application 02 email dated 11.02.2023 against official of P.P. Kot Fatuhi and incharge for harassing him and his family members. He does not want any legal action on his GURPREET KAUR 2023.02.27 21:01 I attest to the accuracy and authenticity of this order/judgment

CRM-M-6280-2023 -2- application and the official of Police Post Kot Fatuhi never raided his house and never raided illegally on his house. Now he does not want any action on his above said numbered application and his application be filed without any proceedings."

While referring to Annexure R-1/T of the said reply, learned State counsel has submitted that since the petitioner herein has made a statement that he does not want any legal action on his application, accordingly, the same may be filed without any proceedings; accordingly, the present petition has been rendered infructuous. In view of the above, learned counsel for the petitioner submits that he may be permitted to withdraw the present petition as having been rendered infructuous.

Ordered accordingly.
