Main case Grievance of the petitioners herein is qua non-disposal of an application filed by him under Order 39 Rule 1 and 2 of the Code of Civil Procedure in their pending civil suit, despite a lapse of more than one and a half years. Despite the pleadings having been completed, stay application is not being disposed of either way, and the same is subjudice for no justifiable reason, contends the learned counsel.

It seems that delay has been caused due to the current pandemic caused by Covid-19 infection, owing to which the Courts in the States of Punjab and Haryana have been working under certain restrictions and taking up matters of extreme urgency through video conferencing. From January 2021, the physical hearings in the Courts in both the States have resumed pursuant to the administrative order passed by this Court. I do not, therefore, find any reason to interfere in the present revision petition. Same is disposed of with an expectation that the concerned Court shall take up the matter and hear the arguments, as expeditiously as possible, on the pending application. At this stage, learned counsel for the petitioners submits that Learned Presiding Officer of the concerned Court is currently on medical leave and same is likely to be extended further on maternity grounds. If that be so, arrangements would be made to get the matter heard by an alternative Court.

Disposed of accordingly.
