***** Rajan Gupta, J. (Oral) This petition has been filed under Section 439 Cr.P.C. seeking regular bail to the petitioner in a case registered against him vide FIR No.206 dated 23.08.2017 under Sections 379-B(2), 411 IPC at Police Station Chheharta, District Amritsar.

Learned counsel for the petitioner submits that the petitioner was arrested on 05.09.2017 and has been in custody since then. Learned State counsel has opposed the prayer for bail on the ground that the allegation against the petitioner are serious in nature. According to him, out of 26 witnesses cited by the prosecution, 16 have been examined. He, however, does not dispute the fact that the petitioner has been in custody since 03 years 05 months and 20 days. Custody certificate is on record.

This court does not intend to express any opinion on the merits of the case. However, keeping in view long incarceration of the petitioner, this court deems it fit to release the petitioner on bail. Accordingly, this petition is allowed. Petitioner is directed to be enlarged on bail subject to the satisfaction of the trial court/Duty Magistrate, Amritsar. This shall, however, be subject to heavy surety and any such condition which the court below may deem it proper to impose.
