HON'BLE MR.JUSTICE H.S. MADAAN H.S. MADAAN , J. (Oral) On account of failure of defendants No.6 to 9, 16 to 18 to file written statement despite availing of several opportunities, the trial Court of Civil Judge (Jr. Divn.), Chandigarh had passed an order striking off defence of such defendants.

Feeling aggrieved, defendant No.6-Tripta Bali has filed the present petition, notice of which was given to respondent No.1/plaintiff, who has put in appearance through counsel.

After hearing learned counsel for the parties and going through the record, I find that though there is no illegality or infirmity in the impugned order, however, in the interest of justice to enable the revision petitioner/defendant No.6 to present her view point before the trial Court so as to have a proper decision on merit, one more opportunity SUMIT KUMAR 2023.03.24 17:42 I attest to the accuracy and authenticity of this order/judgment

is granted to revision petitioner/defendant No.6 by setting aside the impugned order qua her subject to payment of Rs.10,000/- as costs. Revision petitioner/defendant No.6 shall file written statement within 15 days from today and hand over a demand draft in the sum of Rs.10,000/- in the name of plaintiff/her counsel. In case of non-compliance with this direction, the revision petition is to be taken as dismissed. The revision petition stands allowed accordingly.
