Upon completion of the investigation, challan against the appellant was presented before the competent Court. Copies of the same were supplied to the appellant.

After completion of the prosecution evidence, the statement of the accused under Section 313 Cr.P.C. was recorded, wherein all incriminating circumstances appearing against him in the prosecution evidence were put to him. The accused denied the allegations levelled against him and pleaded false implication. The parties thereafter led their respective evidence and advanced submissions before the trial Court. 6.

Upon conclusion of the evidence and after appreciating the oral as well as documentary evidence brought on record, the trial Court arrived at a finding that the prosecution had succeeded in establishing the guilt of the accused beyond reasonable doubt. Consequently, the appellant came to be convicted for the offences alleged against him and was sentenced as above vide the impugned judgment of conviction and order of sentence passed by the trial Court. Aggrieved thereof, the present appeal has been instituted. 7
