Custody Certificate of the appellant filed by learned State counsel in Court today, is taken on record. Office to tag the same at appropriate place. As per the Custody Certificate, the appellant has served out his sentence and the same has not been controverted by the learned counsel for the appellant as well. Learned counsel further submits that he does not wish to make his submissions qua merits of the appeal since findings of facts have been recorded by the learned trial Court.
In view of the fact that the appellant has served out his sentence and the learned counsel for the appellant does not wish to argue the case on merits, the instant appeal has been rendered infructuous. Disposed of as such.
