The present petition has been filed under Section 482 Cr.P.C. for quashing of order dated 04.01.2024 (Annexure P-8) passed by Additional Sessions Judge, SAS Nagar (Mohali), vide which the application for exemption from personal appearance was declined and non-bailable warrants have been issued against the petitioners. 2.

Learned counsel for the petitioners submits that, in fact, the petitioners had noted a wrong date of 04.02.2024 and therefore, when they came to know that the matter was fixed for 04.01.2024, they immediately informed their counsel to move an appropriate application but the learned Court below declined the same without assigning any reason. 3.

However, considering the fact that seeking reply shall only procrastinate the trial and without commenting on the merits of the case, the present petition stands disposed of and the petitioners are directed to surrender before the trial Court on 12.02.2024 and they shall be released on bail by furnishing bail bonds/surety bonds to the satisfaction of trial Court/Duty Magistrate/CJM concerned.

It will be open to the concerned Illaqa Magistrate to consider/ accepting the old bail bonds as till date the old bail bonds have yet not been cancelled.

In addition to the above, the petitioners are imposed with a cost of Rs. 5,000/- each to be deposited in Poor Patients Welfare Fund, PGIMER, Chandigarh, within two weeks from today.
