The petitioner has filed the present petition under Section 482 Cr.P.C., for quashing the FIR No.583 dated 30.09.2020 under Sections 363, 366 IPC and Section 9 and 10 of The Prohibition of Child Marriage Act, 2006 and Section 6 of the POCSO Act, 2012 at Police Station Chandni Bagh, Panipat and all subsequent proceedings arising out of the said FIR.

Learned counsel for the State on instructions from ASI Sunil Kumar submits that the sole accused in the present FIR being the petitioner herein, has been acquitted by the learned Additional Sessions Judge, Panipat on 8.11.2023.

The order sheet shows that the none had appeared on behalf of the parties on 01.11.2022 as the lawyers were abstaining from work and thereafter on 20.02.2023 the matter was adjourned at the request of learned counsel for the petitioner as it was stated that learned counsel has no instructions from the petitioner and he is unable to contact him and has ARCHANA ARORA 2024.04.25 15:16 I attest to the accuracy and integrity of this document

CRM-M-6862 of 2021 2024:PHHC:055021 thus, wanted to withdraw the power to attorney. Thereafter notice was issued to the petitioner. However, the same could not be served on the petitioner as it was found that the petitioner does not reside at the said address.

Accordingly, in view of the statement made by learned counsel for the State, the present petition has been rendered infructuous and is disposed of as such.

However, in case anything survives, liberty is granted to the petitioner to revive the same by filing appropriate proceedings in accordance with law within a period of three months from today, if so advised.
