**** RAMENDRA JAIN, J. (ORAL) Prayer in this petition under Section 438 Cr.P.C. has been made for grant of anticipatory bail to the petitioner, in case FIR No.71 dated 16.04.2017, under Section 61 of the Punjab Excise Act, 1914 at Police Station Division No.1 Ludhiana.
In nutshell, petitioner, during trial in aforesaid FIR, absented on 27.09.2018. Consequently, his bail and surety bonds were cancelled and forfeited to the State. He was ordered to be summoned through non-bailable warrants. Hence, petitioner approached ld. Sessions Court to grant him protection of not sending him jail on his appearance before the trial court, which was granted to him on 29.11.2018. But the petitioner did not comply with the said order of ld. Sessions Court and sought extension of time, which too was granted, but again he did not appear. CRM-M-4521-2019 --2-- Sessions Court granting protection of arrest and sending him judicial custody twice, besides absenting during trial on 27.09.2018. Considering the above aspect, the petitioner does not deserve any concession of anticipatory bail. He is directed to surrender before the trial court within 7 days from today and his bail application on merit shall be decided without prejudice to this order within next 7 days.
Copy of this order be sent to trial court for information and necessary action.
