Learned counsel for the petitioner submits vide order dated 17.09.2019 passed in CWP-25791-2019, cancellation of tender of the petitioner was stayed. Thereafter, the respondents floated another tender and the petitioner filed writ petition (CWP-94-2020), whereby the process initiated vide tender notice (Annexure P-7) placed in that case was stayed. Now the respondents have again floated fresh tender, copy of which has been filed as Annexure P-5.

Vide order dated 17.09.2019 passed in CWP-25791-2019, cancellation of the tender of the petitioner was stayed. Thereafter, vide order dated 06.01.2020, tender notice, Anneuxre P-7, as produced in that case), was ordered to be not finalized till next date of hearing fixed in that petition. Now the petitioner alleges that a tender (Annexure P-5) has been floated. Floating of this tender is not in violation of order dated 17.09.2019 or 06.01.2020, as such, no action is required to be taken in this petition. Dismissed.
