Briefly, the facts of the present case are that a secret information was received by Sub Inspector-Jasvarinder Singh, SHO, Police Station Jaitu that on 17.11.2010, at about 7:30 p.m., he alongwith other Police officials was present on patrolling duty in the official vehicle Bolero bearing registration No. PB-04J-3589 driven by Head Constable Sukhvir Singh. * + "#$%# &#'$$) submits that he does not press the appeal on merits and confines his prayer only to the extent of sentence, seeking the benefit of probation. In this regard, he places reliance on the judgment passed by Hon'ble the Supreme Court in the matter of "Chellammal and another versus State" reported as 2025 SCC Online SC 870 and a judgment passed by this Court in the matter "Darshan Singh versus the State of Punjab" bearing CRR699-2011 decided on 02.04.2025 wherein benefit of probation had been extended. It is vehemently submitted by him that the appellant was less than 21 years of age as on the date of commission of the offence and has been sentenced to imprisonment for a period of two years out of which he has already undergone more than two months. Under similar circumstances, the accused had been granted benefit of probation by the Coordinate Bench of this Court.
