(ORAL) CM No.3189-CWP of 2021 This application has been moved for placing on record the Annexures P-7 to P-13.

Heard. Keeping in view the facts as narrated in this application, the same is allowed and Annexures P-7 to P-13 are taken on the record. CWP No.4201 of 2021 By way of the instant petition, the petitioners have approached this Court for seeking the relief of issuance of a writ in the nature of mandamus directing respondents No.1 & 2 to consider the tenure of service, as rendered by them with the respondent-Department, in C & D category areas and to extend the benefit of the same to them in accordance with the Circular dated 19.03.2014 (Annexure P-1), while averring that they have

served with the respondent-Department in the areas categorized as 'C' & 'D' but the respondents-State, vide order dated 05.10.2020 (Annexure P-4), has withdrawn the said benefit as provided to be extended vide the said Circular (Annexure P-1).

Notice of motion.

Mr. N.K. Banka, Deputy Advocate General, Punjab and Mr. Manpreet Singh, Advocate, who have joined the proceedings on behalf of respondents No.1 & 2 and 4 respectively, in pursuance of the copies of this petition having been sent to these respondents in advance, accept notice on behalf of the afore-said respondents.

Heard.

Learned Senior counsel for the petitioners points out that petitioner No.1 has already moved a representation dated 26.11.2020 (Annexure P-6) to respondents No.1 and 2 for seeking the redressal of his above-discussed grievance and Annexures P-7 to P-13 are the similar representations as moved by petitioners No.6, 1, 2, 4, 7, 8 & 5 respectively to these respondents and he submits that the similar representations would be moved by petitioners No.3, 9, 10, 11, 12 & 13 also by way of supplying the copies thereof to learned State counsel for respondents No.1 and 2 and he further submits that the petitioners would be satisfied in case a direction is issued to respondent No.1 to look into and deal with/decide all the above-said representations of the petitioners within some specific time-frame as the cutoff date for applying for admission in the PG Course is 15.03.2021. counsel for respondent No.4 have no objection for the same. Keeping in view the afore-discussed limited prayer of learned Senior counsel for the petitioners and without commenting upon the merits of the matter in hand, the present petition is hereby disposed of with a direction to respondent No.1-Secretary, Department of Family and Health Welfare, Punjab, to look into and deal with/decide the above-mentioned representations of the petitioners by 05.03.2021 in accordance with law/ Rules/Instructions/Policy/Guidelines and to communicate the decision, as taken by him thereon, to the petitioners through e-mail or any other electronic mode.

This petition stands disposed of accordingly. A copy of this order be supplied to learned counsel for the parties under the signatures of the Bench Secretary of this Court. (MEENAKSHI I. MEHTA) JUDGE 26.02.2021.
