(ORAL) The appellant-wife has come up in this appeal against the judgment and decree dated 23.11.2021, passed by the learned Principal Judge, Family Court, Hoshiarpur, whereby the petition filed by respondent-husband under Section 13 of the Hindu Marriage Act, 1955, for dissolution of marriage by way of decree of divorce was allowed. As per report dated 25.05.2022 sent by the Mediator, the matter has been compromised between the parties for a sum of Rs.14,00,000/- towards full and final settlement. As per settlement agreement dated 25.05.2022 out of the aforesaid agreed amount, Rs.4,00,000/- has to be given by the respondent before the Family Court on 02.06.2022 and Rs.10,00,000/- has to be paid by him today before this Court.

FAO-504-2022 (O&M) -2Learned counsel for the appellant states that both the conditions have been complied with as the amount of Rs.4,00,000/- was paid by the respondent to the appellant on 02.06.2022 before the Family Court and for rest of the amount i.e. Rs.10,00,000/-, the respondent has handed over a demand draft No. 008793 dated 01.07.2022 in the name of minor daughter-Avleen Kaur, for the aforesaid amount in Court today. Photocopy of the said demand draft is taken on record. Since, both the conditions of the agreement dated 25.05.2022, have been complied with, learned counsel for the appellant seeks permission to withdraw the instant appeal. Dismissed as withdrawn.
