This petition has been filed under Section 482 Cr.P.C for direction to official respondents to re-investigate the case FIR No. 118 dated 03.06.2019 under Section 279,304-A, 427 IPC registered at Police Station Kharar District SAS Nagar.

The brief facts of the case are that the petitioner is an Associate Professor at the Gurunanak Khalsa Group of Institutions, Yamunanagar, and holds a Ph.D. in Management. On the day of the incident, the petitioner, along with his family, was traveling in a Swift car bearing registration No. HR-02-AB-3625 from Kurali to Chandigarh. A Mercedes car, bearing registration No. HP-34-C-0003 which was grey-black in colour, being driven at a high speed and in a negligent manner, hit an Activa scooter driven by the deceased Jasbir Singh and his wife was seated as a pillion rider. The accident occurred near the Bus Stand Village Sahota, Tehsil Kharar District SAS Nagar and as a result of this accident with Mercedes, the Activa lost its balance and Renu Rawat 2025.11.20 08.53 I attest to the accuracy and integrity of this document
CRM-M-6231-2024 -2subsequently hit with the petitioner's car, which was behind the Mercedes. Both persons on the Activa died on the spot.

Learned counsel for the petitioner submits that the petitioner was merely driving his car behind the Mercedes and had no role in causing the accident. He further submits that the petitioner moved an application that false case FIR No. 118 dated 03.06.2019 under Section 279,304-A, 427 IPC has been registered against him, investigation was carried out and a report dated 31.07.2019 was submitted, wherein the petitioner was found innocent. He further contends that petitioner has been wrongly implicated in the criminal case and therefore prays that appropriate directions be issued to the official respondents to re-investigate the matter.

In view of the submissions made by learned counsel for the petitioner, the question as to whether the petitioner is involved in the alleged incident is a matter of fact, which is subject to investigation. The petitioner is at liberty to move an appropriate application for further investigation before the competent Court, as may be advised.
