(Oral) Prayer in this petition filed under Section 439 Cr.P.C. is for grant of regular bail to the petitioner during pendency of the trial in case FIR No.86 dated 03.6.2022, under Section 304-B IPC read with Section 34 IPC, registered at Police Station Garhshankar, District Hoshiarpur, Punjab.
Learned State counsel, on instructions from ASI Kulwinder Singh, informs that the petitioner has been acquitted by the learned trial Court vide order dated 26.7.2023. In support of his submission, he has placed on record the copy of order dated 26.7.2023 passed by the Additional Sessions Judge, Hoshiarpur in case FIR No.86 dated 03.06.2022, under Section 304-B read with Section 34 IPC, registered at Police Station Garhshankar, District Hoshiarpur. 2023:PHHC:103386 CRM-M-6586-2023 The same is taken on record. Learned State counsel submits that in view of the said development, the present petition has been rendered infructuous. Even on the last date of hearing i.e. 28.7.2023, there was no representation on behalf of the petitioner and the matter was adjourned in the interest of justice. Even today no one appears on behalf of the petitioner. Order of acquittal of the petitioner dated 26.7.2023 has been produced in Court. Accordingly, in view of the facts and submissions as noted above, the present petition is disposed of as infructuous.
