IN THE HIGH COURT OF PUNJAB & HARYANA, CHANDIGARH

Sr. No.: 112 Civil Revision No.968 of 2022 Date of Decision: October 21, 2022 Pritam Singh (deceased) through LR Jagjit Singh ..... PETITIONER(S)

VERSUS

Shera Singh & others ..... RESPONDENT(S) . . .

CORAM:

HON'BLE MR. JUSTICE TRIBHUVAN DAHIYA . . .

PRESENT: - Mr. Parveen Kumar Garg, Advocate, for the petitioner. . . .

Tribhuvan Dahiya, J (Oral) This revision petition has been filed under Article 227 of the Constitution of India for setting aside order dated 15.02.2020 (Annexure P-1), by which the permission sought to amend the plaint to add relief of declaration of title on the basis of adverse possession has been declined. The trial Court has observed that the petitioner-plaintiff has already pleaded that he has acquired the title by adverse possession, and if the Court arrived at the conclusion that he has been able to prove the fact, the relief on that basis should be granted to the plaintiff. In view of the aforesaid, there is no ground to interfere with the impugned order.

Dismissed.
