The instant petition has been filed on behalf of the petitioner in terms of provisions of Sections 11 and 12 of Arbitration and Conciliation Act seeking appointment of an Arbitrator.

Vide order dated 14.7.2023, the parties had been referred to Mediation and Conciliation Center of this Court. Report of Mediation and Conciliation Center has been received to the effect that the matter stands amicably resolved amongst the parties.

Both the learned counsel have submitted that the matter stands amicably resolved amongst the parties and that as per the said settlement, the respondent - Indus Tower Limited is to pay an amount of Rs.3.30 lakhs to the petitioner towards arrears of rent.

Learned counsel representing the respondent has today passed on a cheque for an amount of Rs.3,32,999/- favouring the petitioner - Sohan Lal to learned counsel representing the petitioner, who has accepted the same. A photocopy of the same has been furnished to this Court, which is taken on record.

Learned counsel representing the respondent has clarified that that an amount of about Rs.37,000/- has been deducted towards TDS as is mandatorily required to be deducted and that the respondent shall ensure that a copy of TDS certificate is duly delivered to the petitioner by 31.1.2024. 6.

Learned counsel representing the petitioner has submitted that he has no objection for the same and that the petitioner is fully satisfied. Learned counsel submits that, in these circumstances, he does not wish to pursue with the present petition and that the same may be disposed of having been amicably resolved.

In view of the aforesaid submission, the instant petition is disposed of having been rendered infructuous.
