The petitioner prays for quashing of the order dated 18.08.2016, whereby his two annual increments with cumulative effect were ordered to be stopped. The appeal, filed against the said order, was dismissed on 07.11.2016.

It is the pleaded case of the petitioner that he was appointed on compassionate basis in August, 2004. Thereafter, he remained absent in the year 2007. The petitioner was punished vide orders dated 25.05.2009, 03.09.2009 and 25.07.2014. In the year 2015, the petitioner filed a civil suit, which was dismissed by the trial Court, however, the appeal was partly allowed by directing the respondents to decide his service appeal, which is stated to be still pending. It is pleaded that the regular second appeal against the aforesaid judgment is also pending. However, no detail thereof has been given.

Civil Writ Petition No. 3421 of 2021 charge-sheeted on 25.09.2015 and thereafter, as noticed above, the order in question was passed on 18.08.2016. This writ petition has been filed on 10.02.2021 i.e. after the lapse of 41⁄2 years. There is no explanation for the aforesaid period. Thus, this Court is not inclined to entertain the writ petition as it suffers from unexplained delay and latches.

With the observations made above, this writ petition is disposed of.
