In the High Court for the States of Punjab and Haryana At Chandigarh CRM-M-6724-2021 (O&M) Date of Decision:-12.2.2021 Gulshan ... Petitioner

Versus

State of Haryana and others ... Respondents

CORAM:

HON'BLE MR. JUSTICE GURVINDER SINGH GILL Present:- Mr. Rajesh Goyal, Advocate for the petitioner. (proceedings conducted through video conferencing) ***** GURVINDER SINGH GILL, J.(Oral) The petitioner has approached this Court seeking issuance of appropriate directions to respondents No.1 to 4 to add Sections 4 and 6 of POCSO Act in FIR No.0054 dated 1.2.2021 registered at Chandnibagh Police Station, District Panipat under Sections 363 and 366 of Indian Penal Code and to get the petitioner's sister recovered from the custody of the accused.

I have heard learned counsel for the petitioner. The FIR in question was lodged barely about 10 days back i.e. on 1.2.2021. It is too early in the day to issue any direction to the police in respect of the investigation.

( 2 ) CRM-M-6724-2021 (O&M) However, needless to mention the police shall take all necessary steps as warranted under law under the facts and circumstances of the case. It is within the domain of the police to add any offence in case the evidence collected shows that some more offences have been committed. It is also expected that during the investigation, the police would be recording the statement of the girl, who is alleged to have been abducted and make all efforts for getting her recovered.

The petition stands disposed off with aforesaid observations. 12.2.2021 ( Gurvinder Singh Gill ) pankaj Judge Whether speaking /reasoned Yes / No Whether Reportable Yes / No PANKAJ KAKKAR 2021.02.12 18:45 I attest to the accuracy and integrity of this document
