Learned State counsel, on instructions from L/Inspector Sudesh, submits that the petitioner has joined the investigation, but certain gold ornaments given in dowry are still to be recovered from him. Learned counsel for the petitioner contends that after joining the investigation, whatever alleged dowry articles were in possession of the petitioner, have been handed over to the Investigating Officer. Merely because some alleged articles of dowry still remained to be recovered, is no ground to seek custody of the petitioner. It is yet to be established during trial as to whether the said articles were given as dowry to him.
In view thereof, the petition is allowed. Interim order dated 29.11.2022, passed by this Court, is made absolute. Pending miscellaneous application(s), if any, stands disposed of accordingly.
