Present writ petition has been filed for quashing of the impugned order dated 05.06.1996 (Annexure P-4), vide which, Joint Secretary to Govt. Of Haryana, Labour Department (respondent No.1), declined the request for referring the dispute to the Industrial Tribunal-cumLabour Court. 2.
Said reference was declined by respondent No.1, primarily, on the ground that the industrial dispute was raised by the petitioner after a period of 13 years.

Mr. J.S. Maanipur, learned counsel for the petitioner, submits that petitioner was terminated from service way back in February, 1982, and the impugned order of declining the reference was passed on 05.06.1996 (Annexure P-4). He further submits that during the pendency of the writ petition, petitioner has already crossed the age of 62 years, and thus, at this stage, the dispute cannot be referred for its decision to the Industrial Tribunal-cum-Labour Court.

CWP-12599-1996 (O&M) - 2 - Besides, the dispute was raised with the delay of 13 years, as noticed in the impugned order itself, thus, learned counsel submits that with the efflux of time, prayer made in the present writ petition has been rendered infructuous, and may be disposed of as such.
