The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to issue him passport.

The petitioner on earlier two occasions also applied for issuance of passport. Due to pendency of FIR, applications of the petitioner were rejected.

Counsel for the petitioner submits that petitioner has applied for issuance of passport vide application dated 04.01.2024. An FIR No. 141 dated 22.12.2014, under Sections 295, 341, 506, 34 of IPC and Section 3 of the Scheduled Castes and Scheduled Tribes Act was registered against the petitioner at Police Station, Kathu Nangal, District Amritsar Rural. CWP No.2945 of 2024 -2- 2024:PHHC:018279 police after investigation filed cancellation report in the afore-stated FIR but trial court ordered further investigation. The police after thorough investigation again has filed cancellation report. Despite the said fact, the respondent has not issued passport.

Notice of motion.

Ms. Amrita Singh, Central Government Counsel for Union of India, who on advance notice is present in Court, accepts notice and waives service. She submits that petitioner may be directed to appear before the passport authority alongwith requisite documents. Thereafter, the passport authority would pass an appropriate order.

Counsel for the petitioner agrees with the aforesaid arrangement.

In the wake of statement of both sides, the petition stands disposed of with a direction to petitioner to appear before the passport authority on 14.03.2024 alongwith requisite documents. On doing so, the passport authority would pass an appropriate order expeditiously.
