Petitioner has filed instant petition under Section 483 of 3$,.$-+4$- 3+ 31"8 for grant of regular bail in FIR No.586 dated 17.04.2023 under Sections 304-B, 34 and 498-A of IPC registered at Police Station Civil Lines, Karnal, District Karnal (Annexure P-1). 2.

Facts of the case are, complainant Rajat filed written complaint against Rambir @ Jonny and others alleging that marriage of his sister Shivani was solemnized with Rambir @ Jonny in October, 2020 according

to Hindu rites. They had given dowry beyond their capacity but even then accused persons were unhappy with dowry articles. His sister was beaten up on account of their demand for more dowry. His father had already expired. They had satisfied some of their demands but their demand for dowry kept on increasing day by day. They used to send his sister to her parental house for months. On two occasions, accused gave beatings to him when he had gone to the house of his sister to meet her. On 17.04.2023 accused persons in connivance with each other hanged his sister Shivani after killing her. They were informed telephonically that victim had committed suicide by hanging. With these allegations, matter was enquired and present FIR was registered.

Learned counsel for petitioner argued that petitioner was arrested in this case on 17.11.2023. Prosecution had examined four witnesses and their statements are annexed as Annexures P-3 to P-6. Allegations levelled against him are vague and without any basis. He is ready to abide by the terms and conditions of bail order. Therefore, his regular bail application may be allowed.

4.

Status report filed. Bail application is opposed by learned counsel representing State of Haryana assisted by learned counsel for complainant. It is pointed out that there are specific serious allegations against the petitioner. It is a case of unnatural death in the matrimonial home. Investigation was completed and the challan was presented on 21.12.2023. Charges were framed on 17.04.2025. Out of 18 prosecution witnesses, 7 witnesses have been examined. Copy of post-mortem report is also annexed

8 as Annexure R-1. Considering the gravity of offence, petitioner is not entitled to be released on regular bail.

5.

I have considered the arguments and have gone through the record carefully. It is a case of unnatural death of the deceased victim in matrimonial home within 21⁄2 years of marriage. Complainant has levelled specific allegations against the petitioner regarding maltreatment given to his sister on account of their demand for dowry. Victim died in the matrimonial home on 17.04.2023. After framing of charges on 17.04.2025, 7 prosecution witnesses are already examined. Complainant PW-1 has supported the prosecution case. Trial is going at good pace. Considering the gravity of offence, I do not find a fit case for grant of regular bail and the same is accordingly declined,3 .! !
