The prayer in the present appeal is to set-aside the judgment of conviction and order of sentence dated 07.03.2009 passed by learned Special Court, Jind whereby the appellant was convicted and sentenced for the offence punishable under Section 15 of the Narcotic Drugs and Psychotropic Substances Act, 1985, in the case stemming from FIR No.133 dated 12.05.2008 registered under Section 15 of the NDPS Act at Police Station Sadar Jind.

Learned State counsel, on instructions from Inspector Subash Chand, submits that during the pendency of the instant appeal, the appellant had died in the month of April, 2007. Copies of the statement made by Sarpanch Sunil and Deepak, grandson of the appellant have been filed in the Court today, which are taken on record as Mark X.

Accordingly, the present appeal is disposed of and the proceedings qua the appellant stands abated.

Liberty is granted to the appellant to file an application for revival of the instant appeal in case the factum of death, as disclosed by learned State counsel, is found to be incorrect. 5.

All the pending miscellaneous application(s), if any, shall also stand disposed of.
