Petitioner seeks grant of anticipatory bail under Section 438 Cr.P.C. in case bearing FIR No.467 dated 31.12.2019 registered under Section 420 IPC and under Section 24 of Immigration Act at Police Station Division No.5, Ludhiana, District Police Commissionerate, Ludhiana.
Notice of motion was issued on 04.02.2020 on the premise that the petitioner is running a Consultancy firm. The complainant was advised as per the norms keeping in view the JYOTI YADAV 2021.09.07 15:28 I attest to the accuracy and integrity of this document
CRM-M No. 4951 of 2020 -2different parameters of age and qualifications. Different schemes have been provided by different countries for providing immigration. Petitioner provided consultancy to the complainant as per his qualifications and also provided coaching of IELTS course. Petitioner has charged an amount of Rs.1,00,000/- out of total Rs.8,50,000/- against receipt including GST and has issued the receipt for the amount so received by him. Learned senior counsel for the petitioner submits that the petitioner has joined the investigation.
This fact has been admitted by learned State counsel on instructions from ASI Harbans Singh and submits that presence of the petitioner is no more required in further investigation of the case.
In view of above, order dated 04.02.2020 is made absolute. However, the petitioner shall keep on joining the investigation as and when required to do so by the Investigating Officer and shall abide by the conditions as envisaged under Section 438(2) Cr.P.C.
Disposed of.
