RAJESH BHARDWAJ, J.(ORAL) Petitioner has approached this Court praying for issuance of direction to respondent No.2-DRDP to expeditiously decide the complaint No.F/6/29 of 2023, Annexure P-2, dated 06.07.2023, as per provisions of the Punjab Panchayati Raj Act, 1994, seeking action against respondent No.4Sarpanch for misuse of office and misappropriation of panchayat funds. Learned counsel for the petitioner has submitted that the petitioner has already filed complaint before respondent No.2-the Director, Rural Development and Panchayat Department, SAS Nagar, for taking action against the Sarpanch for misappropriation of the panchayat funds. He submits that, however, no action has been taken on the same till date. Notice of motion.

On asking of the Court, Ms.Akshita Chauhan, DAG, Punjab, who is present in Court, accepts notice on behalf of the respondents/State and on instructions has submitted that the Director has already taken cognizance on the complaint filed by the petitioner and has marked the MEENU 2024.02.06 14:58 I attest to the accuracy and integrity of this document

CWP-2309-2024 -2inquiry to respondent No.3, i.e. the District Development and Panchayat Officer, Gurdaspur, and the same is pending adjudication, which would be concluded expeditiously.

In view of the statement made by learned State counsel, it is apparent that the inquiry has already been entrusted to respondent No.3 and the same is pending adjudication before him. The present petition is disposed of with a direction to respondent No.3, i.e. the District Development and Panchayat Officer, Gurdaspur, to expedite the proceedings in the inquiry entrusted to him and conclude the same within a month from today.

However, petitioner would be at liberty to pursue his remedy in case any cause of action still accrues to him. February 05, 2024 ( RAJESH BHARDWAJ ) meenuss JUDGE 1.
