(ORAL) Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing FIR No.0171 dated 18.12.2018, registered under Sections 308, 325, 452, 427, 148 and 149 IPC at Police Station Tibba, District Ludhiana (P-1) and all subsequent proceedings arising therefrom, on the basis of compromise (P-2).
Pursuant to order dated 01.02.2019 of this Court, the parties appeared before the trial Court on 08.02.2019 along with receipt of `15,000/- to get their statements recorded. Learned Judicial Magistrate Ist Class, Ludhiana, has submitted her report vide letter bearing No.1038 dated 18.02.2019 duly forwarded by learned District and Sessions Judge, Ludhiana, vide letter bearing No.152/EC dated 21.02.2019. CRM-M-4948 of 2019 --2-- According to the report, ld. Judicial Magistrate Ist Class, Ludhiana, is satisfied that the matter has been compromised between the parties without any coercion, inducement or threat and the complainant has no objection in quashing the impugned FIR. No accused has been declared as proclaimed offender.
Considering the report of ld. Judicial Magistrate Ist Class, Ludhiana, dated 18.02.2019 and the fact that the compromise will bring peace and harmony in relations between the parties, aforesaid FIR No.0171 dated 18.12.2018 along with all subsequent proceedings arising therefrom, is quashed qua the petitioners only. Disposed of accordingly.
