The First Appellate Court has dismissed the petitioner's appeal on the ground that he has failed to make up the deficiency in the payment of court fee.

The learned counsel representing the petitioner contends that the petitioner has already deposited a sum of 58,350/-, whereas the ₹ remaining amount of 59,500/- could not be deposited due to financial ₹ hardship and COVID-19 pandemic. He submits that the petitioner shall deposit the amount within a period of 15 days from today. 3.

Keeping in view the aforesaid facts, the revision petition is disposed of with liberty to the petitioner to file an application for restoration of the appeal on deposit of the balance amount of court fee. If such an application is filed, the First Appellate Court will sympathetically consider the request for restoration.
