Through the instant petition, petitioner has impugned the order dated 08.01.2020 vide which his promotion order dated 07.11.2019 has been withdrawn, without issuance of any show cause notice or opportunity of hearing.

Today, during course of hearing, learned State counsel on instructions from Sh. Dharambir, ADA office of Additional Chief Secretary to Government of Haryana, Public Works(B&R) Department submits that competent authority/respondents would pass fresh orders to mitigate the grievance of the petitioner by giving an opportunity of personal hearing to the petitioner.

Learned counsel for the petitioner submits that he has no objection, if the writ petition is disposed of in terms of submission, ibid. 4.

In view of the above, the writ petition is disposed of with a direction to respondent No.1 to objectively consider the pleas of the petitioner raised in the instant writ petition by treating it as a representation and after SONU 2020.08.19 16:11 I attest to the accuracy and integrity of this document

affording opportunity of personal hearing to him. It is made clear that till fresh order is passed by the respondents, as noted above, operation of impugned order dated 08.01.2020(Annexure P-14) shall remain stayed. It is further directed that in case any adverse order is passed against the petitioner, the same shall not be given effect for a period of two weeks from the date of its communication to the petitioner, to enable him to avail appropriate remedy, permissible under the law, qua the same.
