**** JAISHREE THAKUR, J. (ORAL) Instant writ petition is filed to challenge the selection that had been made for the post of Block Development and Panchayat Officer by contending that there was violation of the judgment of the Hon'ble Supreme Court rendered in Ashok @ Somanna Gonoda and another vs. State of Karnataka, 1992(1) R.S.J. 99 whereby more than 28% marks had been allocated for the viva voce test.

The instant writ petition was admitted to be heard along with CWP No. 11436 of 1995 titled Ajay Kumar vs. State of Punjab and others. The matter is called today and no one is present on behalf of the petitioner to argue the matter. CWP No. 11436 of 1995 has been withdrawn with liberty to the petitioner to revive the petition within a period of three months in case so required.

Instant petition is dismissed giving the petitioner the aforesaid liberty.
