HON'BLE MR. JUSTICE H.S. MADAAN Present:- Mr. Naresh Dilawari, Advocate for the petitioner. *** The case has been taken up through Video Conferencing. Petitioner-complainant Sonia feeling dissatisfied with the offences for which the accused had been booked by the investigating agency while filing final report under Section 173 Cr.P.C. has approached this Court by way of filing the instant petition under Section 482 Cr.P.C. seeking re-investigation/further investigation by constitution of SIT in the case. Although the challan has been filed by the investigating agency in the Court and if certain offences have been deleted, the Court can certainly proceed against the accused for any other offence for which the accused have not been booked provided sufficient material is available on record.

Further more the Court has got power to order further investigation if not satisfied with the investigation carried out by the investigating agency. Learned counsel for the petitioner states that he be allowed to withdraw the present petition granting him liberty to approach the trial Court for redressal of his grievances.

Permission is granted. The petition is dismissed as withdrawn with liberty aforesaid.
