Custody Certificates of both the appellants filed by learned State counsel in Court today, are taken on record. Office to tag the same at appropriate place.
As per the Custody Certificate of appellant Sohan Singh filed by the learned State counsel, appellant Sohan Singh expired on 02.05.2007. Hence, the appeal qua appellant Sohan Singh stands abated. As per the Custody Certificate of appellant Buta Singh, he has since served out his sentence. The said fact is not controverted by the learned counsel for the appellant as well. Learned counsel further submits that he does not wish to make his submissions qua merits of the appeal since findings of facts have been recorded by the learned trial Court.
