In FIR bearing No. 128 of 26.6.2021, an offence constituted under Sections 5/13(2) of the Haryana Gauvansh, and, Gausamvardhan Act, 2015, is, embodied. The FIR (supra) is lodged at Police Station Nagina, District Nuh.

Since it is fairly stated at the bar by the learned State counsel that, insofar as the other co-accused are concerned, they have been granted the indulgence of anticipatory bail, by this Court, through the orders, respectively made on 07.9.2021 upon CRM-M-33612-2021, and, on 07.9.2021, upon CRM-M-31314-2021. It is further submitted at the bar by the learned State counsel, that the inculpatory role of the petitioner/bail applicant in the offence (supra), is not graver, than the one as ascribed to the petitioners, in the above referred petitions. Therefore, this Court is constrained to accord parity to the bail petitioner along with the above stated bail petitioners.

CRM-M No. 6449 of 2022 -2petition. The arresting officer may not arrest the bail applicant-petitioner. However, subject to the bail applicant-petitioner furnishing personal, and, surety bonds in the sum of Rs. 25,000/- each, to the satisfaction of the arresting officer, and, further subject to the abiding by the bail applicant, of the conditions laid down in Section 438 (2) of the Code of Criminal Procedure. The bail applicant shall also give an undertaking before the arresting officer, that as and when he is summoned through a written Hukamnama, he shall ensure his rendering cooperation to the investigating officer.
