*** HARSH BUNGER, J. (Oral) The present appeal has been filed for setting aside the judgment and decree dated 11.11.2002, passed by learned Additional District Judge, Karnal and uphold the judgment and decree dated 08.12.2001, passed by learned Civil Judge, Junior Division, Karnal. 2.

At the outset, learned counsel for the appellant submits that the matter has been settled between the parties and now the appellant- Municipal Committee does not wish to pursue the present appeal any further. Hence, the present appeal has been rendered infructuous. 3.
