MANJARI NEHRU KAUL, J. (ORAL) Petitioner is seeking the concession of anticipatory bail in FIR No.147 dated 02.12.2024 under Sections 316(2)/316(5) of the BNS, 2023, registered at Police Station Phase 11, District S.A.S. Nagar. 2.

Vide order dated 30.01.2025, the petitioner had been granted interim anticipatory bail with direction to join investigation and the relevant part of the said order reads as under:- "Learned counsel for the petitioner, inter alia, contends that the entire case of the prosecution hinges on documentary evidence, which already stands provided to the police at the time of registration of the FIR in question; the entire amount of embezzlement alleged against the petitioner, who was working as a Store Manager in the complainant's firm, was ₹1,665/-. It has been further submitted that the petitioner has no previous criminal antecedents.

Learned counsel for the petitioner submits that in compliance of orders dated 30.01.2025 and 08.05.2025, the petitioner has joined investigation and cooperated with the investigating agency. 4.

Learned State counsel, on instructions from Inspector Aman, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for his custodial interrogation. 5.

In view of the above, the petition is allowed and interim order dated 30.01.2025, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) BNSS.
