Mr. Lalit Yadav, Advocate, for respondent No.2. ***** SUDHIR MITTAL, J. (ORAL) Report dated 15.03.2023 of Ms. Rekha Chaudhary, Judicial Magistrate Ist Class, Kaithal has been received in Court. According to the said report, the statements of the parties have been recorded and a satisfaction has been reached that the compromise is genuine and free from any threat or coercion.

The petitioners have been convicted under Section 323, 326, 452, 148, 149 and 506 IPC and have been sentenced to undergo maximum imprisonment for two years. Appeal against judgment of conviction and order of sentence is pending. Meanwhile, the parties have buried the hatchet and have settled their differences vide compromise dated 05.01.2023.

Learned counsel for the petitioners submits that the parties are residents of the same village. Since they have reached a private settlement, ANKUR GOYAL 2023.03.22 15:08 I attest to the accuracy and integrity of this order/judgment

2023:PHHC:042018 CRM-M-7055-2023 --2-- the interests of justice would be better served if the FIR and all consequential proceedings including the judgment of conviction and order of sentence are quashed. The same would be conducive to the maintenance of peace in the village.

Learned counsel for respondent No.2 accepts the submission made on behalf of the petitioners.

Thus, judgment of conviction and order of sentence dated 02.05.2016 are quashed as is FIR No.183, dated 10.12.2011, registered at Police Station Rajound, District Kaithal, under Sections 148, 149, 323, 324, 452, 506, 326 IPC. The pending appeal has accordingly been rendered infructuous.
