(ORAL) This petition has been filed under Article 226 of the Constitution of India for issuance of a writ in the nature of mandamus directing respondents No.2 and 3 to protect the life and liberty of the petitioners at the hands of respondents No.4 to 7.
As per the petition, both the petitioners are major and have married against the wishes of respondents No.4 to 7 and have sought protection to their life and liberty. They apprehend danger at the hands of respondents No.4 to 7. The certificate and photographs evidencing their marriage are on record as Annexures P-3 and P-4, respectively.
The petitioners have submitted a representation dated 10.02.2022, (Annexure P-5) to respondent No.2-Superintendent of Police, UT Chandigarh. Notice of motion to respondents No. 1 to 3 only. On the asking of this Court, Ms. Simsi Dhir Malhotra, APP UT Chandigarh, accepts notice on behalf of respondents No.1 to 3 only. She, on the instructions from ASI Amarjit Singh, submits that the petitioners are not residing at the given address and rather on the said address, parents of AMAN JAIN 2022.02.15 16:40 I attest to the accuracy and authenticity of this document
CRWP-1368-2022 (O&M) -2petitioner No.1 are residing. She further submits that as per the statement of respondent No.4-Manoj Kumar (father of petitioner No.1), he has no objection regarding the marriage. The said statement has been duly counter-signed by respondents No.5 and 6 (mother and brother of petitioner No.1, respectively). The photocopy of the statement is taken on record as Mark 'A'.
