**** SANJAY VASHISTH, J. (Oral) On 30.01.2023, following order was passed:- "Criminal Complaint No.RBT 1006, dated 22.09.2008, filed by complainant-appellant Amit Garg, and respondent - Gaurav Goyal was tried for the offence punishable under Section 138 of the Negotiable Instruments Act, 1881 (in short 'NI Act'), for bouncing of cheque of Rs.1,20,000/-. Respondent was acquitted and said complaint was dismissed vide judgment dated 06.04.2009, passed by Ld. JMIC, Faridabad.

Thereupon, present appeal was filed before this Court, which is pending since the year 2011. Appeal was admitted on 02.11.2011.

On the previous two dates of hearing i.e. 01.04.2022 and 04.08.2022, present appeal against acquittal was adjourned on request of learned counsel for the appellant. Today, there is no representation on behalf of either of the parties.

In the interest of justice, adjourned to 03.02.2023, as last opportunity."

Today also, there is no representation on behalf of either of the parties.

Dismissed for non-prosecution.
