Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.8 dated 04.08.2018 under Sections 420 and 34 IPC, registered at Police Station NRI, District Bathinda. Notice of motion.

Mr.Dhruv Dayal, Sr.DAG, Punjab, has put in appearance on behalf of the respondent-State and contested the petition. Mr.Siddarth Gupta, Advocate has put in appearance on behalf of the complainant and also contested the petition.

I have heard learned counsel for the parties as well as learned State counsel and have gone through the record. From the record, I find that as per prosecution version, due to the accident by son of the complainant Harjasan Preet Singh on 06.08.2017, VINEET GULATI 2019.03.05 10:43 I attest to the accuracy and authenticity of this document Chandigarh one person died and he was granted bail at the spot. Later on Section 304

CRM No.M-4959 of 2019 -2IPC was added, due to which, it was compulsory for him to appear. Thereafter, one Sukhjiwant Singh @ Soni met the complainant and stated that he knew CBI Inspector Raj Kamal and he will get them bail. As per prosecution version, accused took `13 lakhs from the complainant party. On 21.01.2018, `3,50,000/- were got deposited in the account of Rampal through RTGS.

The petitioner has been in custody since 04.08.2018. He is not required for custodial interrogation as he is in judicial custody. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody till the disposal of the case. Keeping in view the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, the present petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal/surety bonds in the sum of `50,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
