ARVIND SINGH SANGWAN, J. (Oral) This is the first petition filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in FIR No.313 dated 30.5.2019 under Sections 379-A/201 IPC, registered at Police Station City Jind, District Jind. Counsel for the petitioner submits that the FIR was registered at the instance of one Sunil that on 29.5.2019, two boys snatched his mobile phone. Counsel for the petitioner further submits that when the investigation started, two persons were arrested in FIR No.344 dated 14.6.2019 under Sections 379-A and 201 IPC, registered at Police Station City Jind, District Jind and confessed committing the offence in the present FIR. Counsel for the petitioner also submitted that in the said FIR, the petitioner has been granted the concession regular on 9.12.2019 passed by the Sessions Judge, Jind, whereas in the present FIR, in which the petitioner was nominated as an accused after his arrest in FIR No.344 dated 14.6.2019. CRM-M-5102-2020 -2investigation is complete and the petitioner is no more required for further investigation.

Learned State counsel, has filed the custody certificate and as per the same, the petitioner is in custody for the last 06 months and 08 days and on instructions from ASI Birbal Singh, further submits that the investigation is complete. It is submitted that the recovery of the mobile phone was made from the petitioner. Without commenting anything on the merits of the case, considering the aforesaid submission made by counsel for the petitioner and also in view of the fact that the petitioner is not required for further investigation, this petition is allowed and the petitioner is directed to be released on regular bail, subject to his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate/Illaqa Magistrate, concerned.
