Dated Police Station Sections 13.03.2022 Zira, District Ferozepur, 307, 341, 323, 34 IPC (offence Punjab punishable u/s 302 IPC added vide Rapat No.25 dated 29.03.2022 and Sections 3/4 of SCST Act added vide Rapat No.22 dated 05.06.2022 1.

Aggrieved by the order dated 24.01.2024 passed by the Additional Sessions Judge, Ferozepur, vide which application for bail of the petitioner was dismissed, the petitioner has come up before this Court by filing the present appeal. 2.

Petitioner's counsel submits that because of stay granted in CRR-1094-2023 titled as Nirmal Singh vs. State of Punjab and another, trial in the present case has been held up. He further submits that the petitioner cannot be kept in custody simply because the above said Criminal Revision is not decided. Petitioner's contention is that either he be given bail or the trial be expedited.

State opposes the bail considering the serious nature of allegations and offence under Section 302 IPC by filing the reply dated 02.04.2024. 4.

CRA-S-493-2024 2024:PHHC:044388 Court to consider to segregate the trial against the petitioner in the present case from other accused where stay is operating on the proceedings qua them and for any reason, if the case cannot be segregated, the trial Court shall pass a reasoned order and in that case, the petitioner shall be at liberty to file bail application on the ground of delay. Petition is disposed of with the aforesaid observations. All pending applications, if any, stand disposed.
