Today, at the very outset, learned counsel for the petitioner submits that the petitioner may be permitted to withdraw the present petition with liberty to avail of other alternate efficacious remedies as may be available to her for redressal of her grievances i.e. getting the custody back of her minor child aged 21⁄2 years, who is alleged to be illegally kept in custody by respondent No.4 - Kapil Dev.

In view of the aforesaid submission, the instant petition is hereby dismissed as withdrawn with liberty aforesaid.

In case, petitioner approaches the Family Court within a period of one week from today and also files any application alongwith the same seeking interim custody of her minor child, the Family Court concerned shall endeavour to Pankaj Kakkar 2024.02.16 17:52 I attest to the accuracy and authenticity of this document

Since respondent No.4 - Kapil Dev is duly represented by Mr. Sanjeev Virk, Advocate for Mr. Navraj Singh, Advocate, who is present in Court, who has filed another petition i.e. CRWP-1421-2024, which was disposed of vide separate order of even date, it is expected that respondent No.4 - Kapil Dev shall appear immediately before the Family Court as and when notices are issued and shall not try to avoid summons.

The petitioner would be at liberty to serve respondent No.4 by dasti process.
