SUVIR SEHGAL, J. (Oral) The Court has been convened through video conferencing due to Covid-19 pandemic.
Through the instant petition, the petitioner seeks anticipatory bail in case FIR No.109 dated 16.03.2018 registered under Sections 323, 324, 341, 148, 149, 506 of Indian Penal Code, 1860, however, Sections 326 and 201 of IPC were added later on, at P.S.Jodhewal, District Ludhiana. On 06.02.2020, the following order was passed:- "Learned counsel for the petitioner has submitted that injury attributed to the petitioner is baseball blows on the legs of the complainant. He has drawn the attention of this Court to the MLR (Annexure P-1) to submit that out of six injuries noticed SAVITA KADIAN 2021.07.26 16:54 I attest to the accuracy and integrity of this document High Court Chandigarh
CRM-M-5120 of 2020 {2} in MLR, there is no injury on the legs of the complainant. Notice of motion for 24.04.2020.
Meanwhile, the petitioner shall join the investigation and would come present as and when called for and in the event of arrest, he shall be admitted to interim bail on his furnishing personal and surety bonds to the satisfaction of Arresting Investigating Officer. He shall also abide by the conditions as specified under Section 438(2) Cr.P.C.
Learned State counsel, on instructions from ASI Radhe Sham submits that the petitioner has joined investigation and is no longer required for custodial interrogation.
In view of the above facts, but without commenting on the merits of the case, the present petition is allowed and the order dated 06.02.2020 granting interim bail to the petitioner is made absolute, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure.
