RAMENDRA JAIN, J. (ORAL) Through instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner - Ankush - in a case arising from FIR No.1086 dated 11.09.2019 registered under Sections 148, 149, 323, 324, 506 IPC (Section 326 IPC added later on) at Police Station Jagadhri City, District Yamuna Nagar.

According to the prosecution, petitioner along with his 10-15 other accomplice armed with deadly weapons gave lalkara to teach lesson to the complainant for having fight with them and then caused sword blow on the left leg of the complainant.

Learned counsel inter alia contends that co-accused of the petitioner, namely, Sagar @ Chhagri and Nikhil have been granted regular bail by this Court by common order dated 13.01.2020 passed in CRM-M52793 of 2019 and CRM-M-54315 of 2019. -2CRM-M-4999 of 2020 petitioner is lesser to them. He is in custody since 30.09.2019. Conclusion of trial may take a sufficient long time. No useful purpose would be served by detaining the petitioner in jail any more. Treating the case of the petitioner on the same parity as that of his co-accused, he may also be granted regular bail.

On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner.

Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Treating the case of the petitioner on the same parity as that of of his aforesaid co-accused, he (Ankush) is ordered to be released on bail during pendency of trial, if not required in any other case, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
