After arguing at some length, learned counsel for the petitioner contended that he be allowed to withdraw the present petition with liberty to the petitioner to approach the learned Sessions Judge concerned in this regard.

In view of above, present petition stands dismissed as withdrawn with the liberty aforesaid. In case, petitioner takes plea of limitation before the learned Sessions Judge, the learned Court below shall consider the said point favourably.
