NIDHI GUPTA J. (Oral) Prayer in the present petition is for issuing direction to the respondent/authority to decide the application of the petitioner dated 14.11.2023 (Annexure P-1), whereby the petitioner is seeking parole for the reasons stated therein.

Learned counsel for the petitioner submits that the petitioner was convicted in FIR No.1193 dated 16.10.2015, under Sections 363, 363-A, 376 and 302 IPC, registered at Police Station Chandni Bhag, Panipat, District Panipat and sentenced to life imprisonment. Vide order dated 03.03.2023 passed in CRA-D-55-DB2017 titled as 'Deepak vs. State of Haryana', the petitioner's appeal against the above-said conviction has also been dismissed by this Court. Learned counsel submits that on an application made by the petitioner, parole was initiated on 06.1.2023. Thereafter, petitioner had even made a reminder application dated 14.11.2023 (Annexure PVIJAY ASIJA 2024.02.15 19.33 I attest to the accuracy and integrity of this document

Learned counsel refers to Section 12 of the Haryana Good Conduct Prisoners (Temporary Release) Act, 2022 and submits that as per the abovesaid provision, it is incumbent upon the authorities to decide the application of the petitioner in a time bound manner.

Notice of motion.

On asking of the Court, Mr. Ravinder Singh Arya, Addl. A.G. Haryana accepts notice on behalf of respondents-State and has no objection in case the present petition is allowed and the authority is directed to decide the application of the petitioner in a time bound manner.

In view of the above, the present petition is being disposed of with a direction to the respondent No.2-Divisional Commissioner, Division Karnal, District Karnal to decide the application of the petitioner dated 14.11.2023 (Annexure P-1) within four weeks from the date of receipt of certified copy of this order.
