(ORAL) Present appeal has been preferred by appellants-defendants being aggrieved by judgment and decree dated 09.05.2000 passed by learned Additional Civil Judge (Senior Division), Talwandi Sabo, whereby suit for declaration, possession and permanent injunction preferred by respondentplaintiff was decreed and also by judgment and decree dated 10.01.2003 passed by learned Additional District Judge, Bathinda, whereby first appeal preferred by appellants-defendants was also dismissed. 2.
It is asserted that during the pendency of present appeal, the parties have settled all their disputes with the intervention of Panchayat and have entered into a compromise dated 15.12.2025 in presence of witnesses. Copy of compromise has been duly annexed as Annexure A-1 along with affidavit of respondent-plaintiff, wherein he has admitted having entered into a compromise with the appellants-defendants. As per compromise sale deeds SUNIL CHANDER 2026.05.25 16:17 I attest to the accuracy and integrity of this document
RSA No.2332 of 2003 (O&M) -2No.4380, 4381 and 4382 dated 30.03.1995 and sale deed No.1049 dated 01.06.1995 executed in favour of Janta Singh @ Gurjant Singh, Balwinder Singh @ Baljinder Singh, Ajaib Singh son of Banta Singh son of Lal Singh were accepted to have been executed by respondent-plaintiff and respondent-plaintiff has agreed that he will not raise any objection to said sale deeds. It was agreed that RSA No.2331 of 2003 and RSA No.2332 of 2003 may be allowed in view of compromise.

In view of compromise, present application (CM No.129-C of 2026) for disposing the present appeal in view of settlement dated 15.12.2025 (Annexure A-1) as well as present regular second appeal are allowed. Impugned judgment and decree dated 09.05.2000 passed by learned Additional Civil Judge (Senior Division), Talwandi Sabo, whereby suit for declaration, possession and permanent injunction preferred by respondentplaintiff was decreed and judgment and decree dated 10.01.2003 passed by learned Additional Judge, Bathinda, whereby first appeal preferred by appellants-defendants was dismissed are set aside. Suit of respondentplaintiff is dismissed in view of compromise dated 15.12.2025. Parties shall remain bound by the terms of compromise.
