The present Civil Writ Petition has been filed under Articles 226/227 of the Constitution of India for issuance of directions to the respondents to release the gratuity amount due to the petitioner. Learned counsel for the petitioner would contend that the disciplinary proceedings have been pending against the petitioner for the last five years and ten months and his gratuity amount has been withheld on the said account.

Notice of motion.

On the asking of the Court, Mr. Sandeep Moudgil, Advocate, who has joined the sessions through video conferencing, accepts notice on behalf of the respondents and he states that the disciplinary proceedings, which are pending against the petitioner, would be decided in YOGESH SHARMA 2021.02.17 07:48 I attest to the accuracy and integrity of this document

In view of the stand taken by learned counsel for the respondents, the present writ petition is disposed off with a direction to the respondents to conclude the disciplinary proceedings pending against the petitioner, in accordance with law, as expeditiously as possible preferably within a period of two months from the date of receipt of certified copy of this order. In case the petitioner is found to be not guilty, the gratuity amount due to him be released, along with interest, within a period of one month thereafter.

Disposed off.
