The petitioner seeks grant of regular bail in a case registered vide FIR No. 216, dated 21.12.2020, Police Station Guhla, District Kaithal, under Section 15(b) of NDPS Act.

It is alleged that 'Poppy Husk' weighing 1.64 kgs was recovered from the petitioner.

Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case and that in any case the alleged recovery would fall in category of "non-commercial" quantity.

Opposing the petition, learned State counsel has submitted that since the petitioner had earlier also been convicted once for having been found in possession of 'Poppy Husk', no case for grant of bail is made out. It has however, been informed that the petitioner has been behind bars since the last about 2 months.

I have considered rival submissions addressed before this Court. 6.

Keeping in view the nature and quantity of the contraband which is alleged to have been recovered from the petitioner and the fact that the petitioner has been behind bars since the last about 2 months, further detention of the petitioner will not serve any useful purpose. The petition, as such, is accepted and the petitioner is ordered to be released on bail subject to his furnishing bail bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
